Hierunter wird das systematische, zielgerichtete Nachstellen und das Verfolgen des Opfers gegen dessen ausdrücklichen Willen verstanden . Stalking ist jedoch keineswegs ein neues Phänomen. Eine Neuerung kann in der neu aufgekommenen rechtspolitischen Aufmerksamkeit gesehen werden, denn Stalking selbst ist bereits nunmehr seit 20 Jahren verstärkt im Bewusstsein der Menschen . Ende der 1980er Jahre begannen sich bezüglich des Stalkings in den Ländern united states, Kanada, Großbritannien und Australien zunehmend soziale und rechtliche Probleme zu entwickeln . Im Jahr 1990 wurde das erste Stalking-Bekämpfungsgesetzt in Kalifornien geschaffen. Der Schaffung dieses Gesetzes ging jedoch zunächst ein tragischer Todesfall einer Schauspielerin voraus. Es wurde festgestellt, dass der Täter das Opfer einen sehr langen Zeitraum, bevor er dazu über ging sie zu töten, Stalkinghandlungen begangen hatte. Durch die, unter anderem aus dieser Tat, resultierende Aufmerksamkeit für das „neue“ Phänomen und die Skandalisierung von Stalkinghandlungen, die in einem Tötungsdelikt endeten, wurde das Gesetz befördert. Solche Delikte wären vermutlich durch die Möglichkeiten von Sanktionen durch eine bereits existierende Strafnorm vermeidbar gewesen.

Meine Ausarbeitung stellt im Folgenden dar, welche Schwierigkeiten sich aus dem nun auch in Deutschland eingeführten Stalkingparagraphen § 238 StGB bezüglich des Anwendungsbereichs und der Dogmatik ergeben können. Ich werde zunächst in Teil B meines Textes kurz die Entwicklung der Stalking-Gesetzgebung in Deutschland ansprechen. Danach werde ich vom Begriff des Stalkings (II.), über die bisherige Rechtslage bezüglich des Stalkings (III.) zum Grundtatbestand des § 238 StGB (C.) kommen. Unter diesem Punkt findet eine Beleuchtung des Grundtatbestandes (I.), unter genauerer Betrachtung der Tathandlung (1.), des Taterfolges (2.) und des subjektiven Tatbestandes (3.) statt. Über die Ausführungen zur Erfolgsqualifikation in § 238 II StGB (II.), komme ich schließlich zur Erfolgsqualifikation in § 238 III StGB bis meine Ausführung in Abschnitt D. mündet, in dem es um die Stelle der Eingliederung des § 238 StGB in das Strafgesetzbuch geht.
